These Terms of Use ("Terms") constitute a legally binding agreement between you and Day ™ Production ("Company," "we," "us," or "our") governing your access to and use of the Won't Whine platform, including its website, AI recommendation engine, and all related content, features, and services (collectively, the "Service").
By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must immediately discontinue use of the Service.
Age Requirement & Eligibility
The Service is intended for individuals who are of legal drinking age in their jurisdiction — typically 18 or 21 years of age depending on your country of residence. By using the Service, you represent and warrant that you meet the legal drinking age requirement applicable in your location.
Won't Whine does not encourage or promote alcohol consumption. Our Service provides information and recommendations about wine for informational and cultural purposes. It is your responsibility to consume alcohol responsibly and in accordance with the laws of your jurisdiction.
Informational Purposes Only — No Professional Advice
All content, recommendations, and information provided by Won't Whine — including AI-generated wine suggestions, flavour profile descriptions, pairing notes, and region or vintage information — are provided for informational and entertainment purposes only.
Nothing on this platform constitutes professional sommelier advice, and no information provided by the Service creates an advisory relationship of any kind. Wine suitability is highly personal and subjective. You should use your own judgement and, where appropriate, consult a trained wine professional.
AI-Generated Recommendations Disclaimer
Won't Whine uses artificial intelligence and a curated wine database to generate personalised recommendations. You acknowledge and agree that:
- AI-generated recommendations are probabilistic and may not be accurate for your specific situation or palate;
- Wine taste and character are highly subjective and may vary from how we describe them;
- The wine database is updated periodically but may not reflect current market availability or pricing;
- Recommendations do not account for individual health conditions, medications, or sensitivities to alcohol or sulphites.
You use any recommendation provided by Won't Whine entirely at your own discretion and risk.
Permitted & Prohibited Use
You may use the Service for personal, non-commercial informational purposes in accordance with these Terms. You agree that you will not:
- Attempt to reverse-engineer, scrape, copy, or extract data from the Service or its underlying AI models;
- Use the Service to facilitate any illegal activity;
- Submit false, misleading, or harmful content via any input fields;
- Interfere with or disrupt the operation of the Service or its servers;
- Use automated means (bots, scrapers, crawlers) to access or interact with the Service without prior written consent.
Intellectual Property
All content, design, code, graphics, AI models, data structures, and other materials comprising the Service are the exclusive property of Day ™ Production or its licensors and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes. No rights are transferred to you except as expressly stated in these Terms.
Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or that any recommendation will suit your personal taste or requirements.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DAY ™ PRODUCTION AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE — INCLUDING, WITHOUT LIMITATION, DECISIONS MADE IN RELIANCE ON AI-GENERATED RECOMMENDATIONS.
Our total cumulative liability to you for any claims arising under these Terms shall not exceed USD $100.
Governing Law & Modifications
These Terms are governed by and construed in accordance with the laws of the United States and the applicable laws of the state in which Day ™ Production is incorporated, without regard to conflict of law principles.
We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
Introduction & Scope
This Privacy Policy describes how Day ™ Production ("we," "us," or "our") collects, uses, stores, and shares information when you access or use the Won't Whine platform ("Service"). By using the Service, you acknowledge that you have read and understood this Privacy Policy.
Information We Collect
Information you provide directly:
- Emotion chip selections and mood preferences you make when using the recommendation engine;
- Free-text notes and additional context you add to your wine requests;
- Email address, if you join the Won't Whine Pro waitlist.
Information collected automatically:
- Device type, operating system, and browser information;
- IP address and approximate geographic region (country/state level);
- Pages visited, features used, and session duration;
- Referring URL and session identifiers.
We do not collect government-issued identification, precise location, biometric data, or financial information.
How We Use Your Information
We use the information we collect to:
- Provide, operate, and improve the AI recommendation engine;
- Personalise and contextualise wine recommendations based on your stated preferences;
- Conduct internal analytics to understand how users interact with the Service;
- Detect and prevent misuse or fraudulent access;
- Communicate with you if you have opted in to Pro waitlist communications;
- Comply with applicable legal obligations.
How We Share Your Information
We do not sell, rent, or trade your personal information to third parties.
We may share information only in these limited circumstances:
- AI inference: Your emotion selections and notes are sent to OpenAI's API to generate recommendations. OpenAI processes this data in accordance with their API data usage policies. We do not send identifying personal information alongside your wine queries.
- Service providers: Trusted third-party vendors who assist in operating the Service, bound by confidentiality obligations;
- Legal requirements: When required by law, court order, or to protect the rights and safety of users;
- Business transfers: In the event of a merger or acquisition, subject to equivalent privacy protections.
Cookies & Session Storage
Won't Whine uses minimal browser storage technologies:
- Session memory: Your current conversation context is held in the browser's session memory to enable follow-up questions within a session. It is not persisted after you close the tab.
- Analytics: We may use privacy-respecting analytics tools to understand aggregate usage patterns. No individual profiling is performed for advertising purposes.
We do not deploy third-party advertising cookies, social media tracking pixels, or retargeting technologies.
Data Retention
Emotion chip selections and free-text notes submitted during a session are used to generate your recommendation and are not stored beyond that request. Email addresses collected via the Pro waitlist are retained until you request deletion or we launch Pro, whichever is sooner.
Anonymised and aggregated analytics data may be retained indefinitely for product improvement purposes.
Your Rights
Depending on your jurisdiction, you may have rights to access, correct, or delete your personal information. To exercise any of these rights, contact us at hello@wontwhine.com. We will respond within 30 days.
California residents (CCPA): You have the right to know what personal information we collect, the right to delete it, and the right to opt out of its sale. We do not sell personal information.
Security
We implement reasonable technical and organisational safeguards to protect your information from unauthorised access or disclosure. However, no method of internet transmission is 100% secure, and we cannot guarantee absolute security.

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date. Your continued use of the Service after any update constitutes your acceptance of the revised Privacy Policy.
